By accessing to order video editing services on the website of Bride and Groom, Inc. (“Company”, “we”, “us”, or “our”), you agree to be bound by the following Terms of Service:
- SERVICES
- By using our platform, you grant us permission to utilize all necessary information and raw footage that you provide to create a polished, professional wedding video that aligns with your style and preferences.
- We offer various video formats based on your needs, including but not limited to, a highlight video, full documentary, 1-minute trailer, or custom formats.
- Our team uses Adobe Premiere Pro, Final Cut Pro, or DaVinci Resolve to edit videos, and you can specify your preferred software.
- We assure high-quality visuals through color correction and basic color grading, as well as a sound enhancement for balanced dialogues, music, and ambient sounds.
- We provide appropriate music and sound effects, ensuring they are properly licensed and royalty-free. If you wish to provide your music, you are responsible for ensuring it is appropriately licensed.
- Our services include adding suitable transitions and visual effects according to your specified style and tone.
- Upon completion, the final edited videos, project files, and license keys for music used will be delivered to you in your preferred format.
- PAYMENT AND PRICING
- Full payment is required before the start of the project. For first-time clients, a 50% non-refundable retainer is acceptable, with the remainder due after approval of the video.
- We accept payment via credit card, PayPal, bank transfer, or other mutually agreed-upon methods.
- Extra charges apply to projects where 5 or more cameras were used or total footage length exceeds 8 hours, or specialized LUTs or plugins are required.
- Our pricing includes two revisions. Additional revisions may result in extra charges based on the changes required.
- As a special offer, first-time clients will not be limited on the number of revisions for the first order, unless they significantly exceed the original scope.
- Once invoiced, the full payment must be made within 14 days to initiate the project.
- DELIVERY AND REVISIONS
- The typical delivery time for each project is 14 days from the receipt of all required materials.
- After receiving the final video, you have 1 month to review and request any revisions. If no feedback is received within this period, the project will be considered approved.
- Post-delivery, we offer a 1-month period for revisions included in the cost. Any revisions requested after this period may be subject to additional fees.
- Requests for music replacement after editing has begun or been completed may incur an additional fee. The fee will be determined based on the complexity and scope of the required edits to integrate the new music.
- PRIVACY AND CONFIDENTIALITY
- We value your privacy and handle your data in compliance with our Privacy Policy.
- We maintain the confidentiality of all proprietary and confidential information shared by you, including raw footage and other assets.
- We may use the final edited video for marketing purposes, only after receiving written permission from you.
- LIMITATION OF LIABILITY
- We are not responsible for any damages arising from the use or inability to use our services.
- TERMINATION
- Either party has the right to terminate the services upon 10 days’ written notice if the other party breaches any material term of these Terms of Service.
- INDEPENDENT CONTRACTOR RELATIONSHIP
- Our relationship with you is as an independent contractor. We do not have any authority to enter into any agreements on your behalf, nor do we claim any partnership or employment relationship with you.
- OWNERSHIP AND RIGHTS
- Upon receipt of full payment, you will be granted an exclusive, perpetual, and worldwide license to use, reproduce, and display the edited wedding videos.
- Subject to your written consent, we may use the edited wedding videos for marketing purposes on our website and/or social media channels, while complying with any restrictions you stipulate.
- All raw footage and other materials you provide remain your property. We do not claim any ownership rights over them.
- WARRANTIES
- We warrant that we have the necessary skills, experience, and resources to perform the services as per your requirements and in compliance with industry standards.
- You warrant that you have the necessary rights and permissions to provide the raw footage and other materials required for us to perform the services.
- FORCE MAJEURE
- Neither party will be held responsible for any delay or failure to perform its obligations under these Terms of Service due to circumstances beyond its control, including natural disasters, acts of God, war, terrorism, labor disputes, or governmental actions.
- GOVERNING LAW AND DISPUTE RESOLUTION
- These Terms of Service will be governed by and construed in accordance with the laws of the State of Delaware.
- Any disputes arising out of or related to these Terms of Service shall first be attempted to be resolved through good faith negotiations. If unable to resolve within 90 days, the dispute will be submitted to binding arbitration under the rules of the American Arbitration Association or a mutually agreed arbitration body.
- MODIFICATION OF TERMS
- We reserve the right to modify these Terms of Service at any time. The date of the last update will be posted at the bottom of this page. Continued use of our services after changes implies your acceptance of these changes.
